Orphan Works Copyright Law Being Considered Again in the US

Everything You Know About Copyright Is About To Change - Brad Holland

Here below is the original content I originally posted:

Recently, I received more mail on the subject of Orphan Works Legislation. The body of the letter was actually the text from this website: https://www.conceptart.org/forums/showthread.php?t=145485 And here is the video mentioned in the text:

My answer to this would be: Interesting, to a point. Understandably, everybody is up in arms about this.To get a better view, maybe check out this site: http://fairuse.stanford.edu/index.html and look under the tab: Legislation. From there, you will find many useful links, articles and blogs regarding this subject.

These I found informative and interesting:

My Quote: NO SOUP IS EATEN AS HOT AS IT IS COOKED. It won't fly without amendments. Currently, there are many art and photo sites on the internet, and from what I read, I don't need a "paid for registry" (though some poor sap might be conned into that) - the existing ones (and any that may follow to make a quick buck) , in my opinion, rate on the same level as Vanity Galleries. The (free) service ConceptArt speaks of is also served by many other sites (I belong to oodles of art and photo sites, besides my own website, and through any one of them searchers can get my contact easily, so none of my works are 'orphaned')............

The Minoan Epiphany - A Bronze Age Visionary Culture

I am posting here a copy from my friend Bruce Rimell's publication, with the purpose to bring it to a larger audience.

The original web page is found HERE

THE MINOAN EPIPHANY: A Bronze Age Visionary Culture

Archaeological Evidence for Ecstatic Ritual and Altered States of Consciousness in Cretan Prehistory

Genre: Archaeology / Art / Aegean Prehistory
Size: 296 pages with over 180 illustrations
Format: PDF Electronic Publication
Release Date: January 2021
Available to read or download for free via the links below

Representing an interesting forerunner to Bruce Rimell's Visionary Humanist philosophy which represents the majority of his current independent research interests, ‘The Minoan Epiphany: A Bronze Age Visionary Culture’ is the culmination of several years of research into the Minoan civilisation and surrounding contemporary cultures of the Bronze Age Aegean.

This volume gathers research from 2009-13, which formed a website presentation entitled 'The Minoan Epiphany', together with art historical essays on Minoan themes from the years 2014-15, supplemented with new research on selected Bronze Age Aegean artefacts conducted in 2020.

This 296 page Electronic Publication in PDF format is exclusively available for free download from Xibalba Books and a higher quality version from Bruce Rimell's Academia.edu portal. A version of this Electronic Publication is also available for free viewing at Google Books.

Another one bites the Dust

I have not checked lately about some of the art sites I joined, but until just now, there was a link listed here on my Blogger to a site ZEIGDEINEKUST: it does not exist anymore, except for some remnants that make no sense - see it here: http://www.zeigdeinekunst.de/ ◄ but careful, it may not be safe, so check it out in safe mode. I find it sort of goofy that they actually maintain a domain like this with bad web pages.

Checking the Internet Archive for my particular page, I found this: https://web.archive.org/web/20130821093647/https://www.zeigdeinekunst.de/zdk-portal/userProfile/show/6830

Jos Pirkner's monumental work

On Friday, October 19th while visiting Anni Fuchs at the Ernst Fuchs Museum I met the most fascinating artist, Jos Pirkner, whom Anni introduced me to. His monumental work just left me speechless!

JOS PIRKNER

Jos Pirkner was born on 2 December 1927 in Sillian, East Tyrol. He attended the School of Applied Arts in Klagenfurt, graduated from the Master School of Applied Arts in Graz. He discovered his love for metalwork as a private student of Rudolf Reinhart in Salzburg.

Excerpt from his Biography, translated from German:

The young artist followed an offer from the Brom brothers in 1951 and began working as an independent gold and silver sculptor for this world-famous studio in the Netherlands. Jos Pirkner was accepted by the Academy of Fine Arts in Amsterdam and attended as a guest auditor the Free Academy in Utrecht. This city was his second home for the next 25 years. Pirkner opened his own studio and married in 1966 Joke Baegen. Immediately after the birth of his son Gidi, he returned to East Tyrol in 1978. Prof. Jos Pirkner lives with his family in Tristach near Lienz. The work of Jos Pirkner unites imagination and energy. And another, rare quality of a sculptor: the sense of human sensitivity. In the midst of the destruction and poverty of the post-war years, my parents have financed me with an artistic education. Where bread is scarce, art has no value. Nevertheless, my parents advised me to go my own way, as did the Dutch painter Charles Eyk years later, whom I met in Amsterdam. These people have not shaped my work, but my personality as an artist. I owe to them the self-confidence, undeterred by commercial and intellectual fashions, simply to make my art.

I feel privileged to have met this great artist!

Creating Custom Books for the Holidays

Creating Custom Books for the Holidays?
Blurb's Book Making Boot Camp Makes It Easy!

(sponsored post) - here are some examples from  fellow artists:
It could be just me, but I think it's much easier to learn how to do something by watching a video (even if it's a short one). For instance, making your own custom book seems like it would be really complicated, but then you watch a video walking you through it and it becomes pretty understandable. Here's a quick video from Blurb (less than 3 minutes) that quickly walks you through publishing your own book using their BookSmart tool — sort of a book making boot camp. Save 20% on photobooks which is great news if you're thinking ahead to the holidays and making a gift to send. Special offer for new customers only. Save 25% on photobooks… even better for those of you who are new to Blurb books. Just don't wait because these deals end October 31st.

Take advantage of these offers by using the respective promo code at the check-out.

SAY NO TO FREE ART - and related stories

Several years ago on
a post appeared that garnered quite some attention. It is titled

Every day, there are more and more posts on here seeking "artists" for everything from auto graphics to comic books to corporate logo designs. More people are finding themselves in need of some form of illustrative service.

But what they're NOT doing, unfortunately, is realizing how rare someone with these particular talents can be.

To those who are "seeking artists", let me ask you; How many people do you know, personally, with the talent and skill to perform the services you need? A dozen? Five? One? …none?
These are just the first few lines - there is more, and there are hundreds of comments on it. READ MORE HERE

But as I had some good comments to add to it, I am afraid they might get lost in the crowd, so let me add them here on my blog as well, because one most recent incident  needs to be put out front and center, the story of Designer Juan Luis Garcia

UPDATE Dec. 5th 2013: well, the response below is still on twitter, but the letter posted on line, (with images , now gone) does not exist anymore. Is there a story? Perhaps. If the tweets exists, the story certainly had been there ..... bought out? chickened out? Settled? Who knows. There is still a post on Yahoo with some info about it. More about it also on The Daily Dot. And of course Spike Lee's twitter:

- this story is the perfect illustration for point 6 in the above article on deviantART, which reads:

6. (This one is FOR the artists out there, please pay attention.) Some will ask you to "submit work for consideration". They may even be posing as some sort of "contest". These are almost always scams. They will take the work submitted by many artists seeking to win the "contest", or be "chosen" for the gig, and find what they like most. They will then usually have someone who works for them, or someone who works incredibly cheap because they have no originality or talent of their own, reproduce that same work, or even just make slight modifications to it, and claim it as their own. You will NOT be paid, you will NOT win the contest. The only people who win, here, are the underhanded folks who run these ads. This is speculative, or "spec", work. It's risky at best, and a complete scam at worst. I urge you to avoid it, completely.
So to artists/designers/illustrators looking for work, do everyone a favor, ESPECIALLY yourselves, and avoid people who do not intend to pay you. Whether they are "spec" gigs, or just some guy who wants a free mural on his living room walls. They need you. You do NOT need them. Say NO to free art.

Some time earlier, October 2013,  in the New York Times Sunday Review a article appeared:

- a short excerpt from the second page:
".....I know there’s no point in demanding that businesspeople pay artists for their work, any more than there is in politely asking stink bugs or rhinoviruses to quit it already. It’s their job to be rapacious and shameless. But they can get away with paying nothing only for the same reason so many sleazy guys keep trying to pick up women by insulting them: because it keeps working on someone. There is a bottomless supply of ambitious young artists in all media who believe the line about exposure, or who are simply so thrilled at the prospect of publication that they’re happy to do it free of charge......"

It is recommended to read the whole article by Tim Kreider, Published: October 26, 2013 HERE
and also check the Comments

Another good example (published 11.06.13 on 'Dangerous Minds'):

Amidst the ongoing discussions about the value of music, British alt/rock/tronica artist Whitey has had enough of being asked to donate his music for free to large companies who, by rights, can and should be paying him. After receiving one such email from a company called Betty TV, Whitey, aka NJ White, wrote this caustic response and posted a screenshot on his facebook page:

I am sick to death of your hollow shtick, of the inevitable line “unfortunately there’s no budget for music”, as if some fixed Law Of The Universe handed you down a sad but immutable financial verdict preventing you from budgeting to pay for music. Your company set out the budget. so you have chosen to allocate no money for music. I get begging letters like this every week – from a booming, affluent global media industry.

HOCHOSTERWITZ - A METAPHORIC JOURNEY TO THE TOP

In the Austrian province of Carynthia, about 20 km from the St. Egid Chapel in Klagenfurt (famous for Ernst Fuchs' elaborate interior *) you will find the Fortress Castle of Hochosterwitz.

Situated on a 500 foot high rock, you ascend to the castle proper via 14 fortified gates on a 2000 foot long path. There are new and exciting vistas found at every turn of the way, spiralling upwards toward this magnificient structure. It has been said that this castle had never been conquered, and no enemy ever made it past the 4th gate.

Arriving at the top, the view over the land is magnificient in every direction. The illusion persists that on a clear day, one could see as far as Italy.

I am comparing this journey to the spiritual journey one takes while creating art when first setting down a mark. This initial mark is the entry point on your journey through the inner universe. Each successive mark, like one of the gates of the Hochosterwitz, is taking a step closer to revelation. As you ascend, the journey gets more complicated, since the keys to the gates are more like tumblers - you need to assemble that which you have learned so far in the right and specific order to unlock the next step, to defeat the elaborate defense mechanism barring you from going any further.

Imagine now, if you will, that a quick and easy way to the top is provided via a cable car or an elevator. You simply pay at the bottom to be taken to the top. When you get there, you may view the same vista that I do, but what you miss is the journey upwards and the many wondrous things encountered along the way, as well as the appreciation, sense of bliss and satisfaction of having accomplished this ascent. Your view might be the same, but your appreciation of it lacks the experience of the trip and thus I would suspect the understanding and awe of what you see at the top.

Entheogens are the elevators that you may use to spare you the journey to get to the top. In my opinion, it is accomplishing the journey itself that counts here and truly lets you appreciate what you find when you get there.

Rather than a pale snapshot of the top view, when taking this journey on your own power, your art would reflect this whole experience in its entirety.
